QVC – MAY SWEEPSTAKES – OFFICIAL RULES
QVC, Inc. (“Sponsor”) is the Sponsor of this sweepstakes.
No purchase necessary. Entrants must be 18 years of age or older and reside in the U.S. or its territories. Employees and agents of Sponsor, and their parents, affiliates and subsidiaries, and immediate family members and household members of employees and agents are not eligible to participate. Sponsor is not responsible for incorrect or inaccurate transfer of entry information, human error or late, inaccurate, incomplete, stolen, misdirected, mechanically reproduced or illegible entries. A purchase or payment of any kind will not increase your chances of winning. All entrants agree to abide by the Official Rules.
To enter, go to https://www.qvc.com/content/featured/sweepstakes.html to sign up to agree to receive promotional emails from QVC. To enter without agreeing to receive promotional emails, send a postcard with your name, address and email address to QVC May Marketing Giveaway, 1200 Wilson Dr., West Chester, PA 19380. The information on the postcard will be used for notification purposes only, should you be a winner. The promotion runs from May 10, 2021 EST and ends on May 24, 2021 EST. Postcard entries and email entries have the same chance of winning. Postcard entries must be received no later than May 24, 2021. Each day’s promotion is a different sweepstakes with a separate pool of entries.
A random drawing from all eligible entries will be conducted each day to determine the daily winner. The daily winner will be awarded a $1000 QVC eGift card. Each daily prize winner will be required to complete an Affidavit of Eligibility and Release and a W-9 (Request for Taxpayer Identification Number) Form within 7 Days of receipt. Should a winner fail complete and return the documents within the required time period, fail to agree with the Official Rules or is otherwise ineligible, an alternate winner may or may not be selected. Winners will receive the eGift cards within two to four weeks of the individual drawings.
Except where prohibited by law, all entrants release and hold harmless Sponsor, its owner, directors, officers, employees, attorneys, representatives, affiliates agents, successors and assigns (“Released Parties”) from any and all liability in connection with the participation in the sweepstakes promotion. Should it be determined that the promotion was compromised in any manner, Sponsor reserves the right to cancel the giveaway. Sponsor reserves the right to seek damages from any such person to the fullest extent of the law.
Entrants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, the Rules, the prize or the determination of the Winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association then in effect, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes (if any), but in no event shall any party be entitled to attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased, and (4) entrant’s remedies are limited to a claim for money damages (if any) and entrant irrevocably waives any right to seek injunctive or equitable relief. If you live in a jurisdiction that does not allow limitations or exclusion of liability for punitive, incidental or consequential damages, then the above limitations may not apply to you. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without regard for its conflicts of law principles, and all proceedings shall take place in the City of Philadelphia, County of Philadelphia, Pennsylvania.
The odds of winning each of the daily drawings depend on the number of eligible entries. The prize is non-transferable or redeemable in cash. Taxes are the responsibility of the winner. In the event that any provision of the official rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision (s) were not contained herein. Sponsor reserves the right to cancel the promotion, should it be compromised in any manner.
