How do you treat my information if I check out on QVC.com without entering a password?

When you place an order on QVC.com without entering a password, QVC collects the same type of information from you and treats  it in the same responsible way as if you had entered a password, because when you place an order, we automatically create a QVC account for you. In order to view or change the information on your account, you'll need to create a password and log in to the My Account section on QVC.com.

What personal information do we collect from our customers?

We gather personal information about our customers so we can better serve you, and we make reasonable efforts to ensure the security of your personal information and to treat that information responsibly. We collect the personal information that you give us voluntarily or in response to our request when you choose to purchase a product from us or use one of our services. For example, when you register with QVC, we'll ask you to provide information such as your name, email address, physical address, and phone number. Registration with QVC is generally required to make a purchase or to use one of our community functions, such as posting a message on a community forum or submitting a product review. Similarly, we'll ask you for contact information if you use our notify-a-friend program or if you request that we send you eNewsletters or other promotional notices or seek information or assistance from us.

If you purchase a product, we'll also ask you for financial information, such as your QCard® or other credit card number, and for a billing address and a shipping address.

Additional personal information may be collected from you in connection with your use of certain optional services and features we offer. For example, if you register for QVC's mobile services, we'll ask you to provide information such as your cell phone number and the name of your mobile provider, as well as the payment method, billing address, and shipping address you want to use for any purchases through this service. You'll also be requested to specify payment and shipping information in advance if you want to purchase items using a speed purchase feature. Similarly, entering one of our contests or sweepstakes, submitting an employment application, or using one of our community functions may involve our collection of further personal information from you, such as your social security number and chosen nickname. If you sign up to receive Today's Special Value® emails, messages, or eNewsletters, you may be asked to provide information concerning your personal interests. We may also collect personal information from your creation of wish lists or reminders.

If you're a member of one of our third-party affinity programs, we may also collect personal information from you about your membership and your purchases from us.

 

What other kinds of customer information do we collect?

If you ask us to ship a purchase to somebody else or you use our notify-a-friend feature, we'll ask you to provide the name and address or email address of the person to whom you're sending or recommending the product, as well as your name and contact information.

We may also obtain personal information about you, such as contact information; updated address and shipping instructions; and credit information from agents, consultants, contractors, carriers, and other third parties. We may also collect contact and other information about prospective customers.

Additionally, our system keeps track of technical information about your computer or mobile device, such as the browser type and version, browser plug-in types and versions, and operating system of your computer, the Internet Service Provider (ISP), or other provider you use to access certain of our services, and your internet protocol (ip) address, location, and time zone setting. To help us understand the use of our services by our visitors and improve your shopping experience and to aid us in marketing and managing our services, we also automatically collect information as to how you were directed to them, how you navigate around them, what products you browse, and your purchasing activities.

 

How do we collect this information?

When you register with QVC, we compile the personal information you give us about yourself into an individual profile, adding other personal information about you to that profile as we obtain it. We also collect information about your purchases and other uses of our services as they occur.

Personal and other information about prospective customers may be collected by us or obtained from our business partners or other third parties.

We automatically gather other information (including the technical information identified above) when you access certain of our services, including through the use of cookies and web beacons.

 

How do we use cookies?

Cookies enhance our ability to serve you. Basically, they're pieces of text that a website stores on your computer—an identification code of sorts. This cookie can be accessed by the website when you revisit it.

We use two types of cookies: session cookies and persistent cookies. Session cookies terminate shortly after you terminate your internet session. Persistent cookies are stored on your hard drive until they expire or are deleted. How do we use web beacons?

Web beacons are small, transparent graphics that are placed on web pages to track how visitors arrive at a website and what they do there. We use web beacons to track customers' visits to and browsing activities at our websites and to compile sales and statistical data. For example, beacons let us know when a purchase is made on one of our websites by a member of one of our third-party affinity programs and when a purchase is initiated by an advertisement we placed on a third party's website. What if you don't want to give us personal information?

Personal information is required for you to make a purchase, request information or assistance, or take advantage of certain services and features we offer, such as QVC's mobile services and desktop applications, our notify-a-friend feature, community functions, contests or sweepstakes, or online employment applications. How do we protect our customers' personal information?

QVC participates in the VeriSign Secured Seal Program. All of your personal information is encrypted by Secure Sockets Layer (SSL) software when it's transmitted to us via the Internet to any website address beginning with https. We maintain the servers that store this information in a facility with restricted access. We also truncate your credit card number to the last four digits when we communicate with you about your order.

 

How do we use information about our customers?

We use your personal information to process your orders. This includes, for example, contacting you to confirm your order, fulfilling it, and shipping it. We may also contact you about your order.

Additionally, we'll use your contact information to send you eNewsletters or other promotional notices, or to respond to requests for information or assistance from you.

If you're a member of one of our third-party affinity programs, we'll use and disclose your personal information to administer and manage that program. How do we share customers' personal information with third parties?

In order to receive and process your orders and requests, we may provide your name, address, and other personal information, such as your email address and phone number, to other entities, such as credit card companies and package delivery services (for example, American Express, Visa, UPS, and USPS). Similarly, if you order a product that is shipped directly from another company, or offered by us in conjunction with another company, we'll share personal information about that order with the other company.

We may use third-party agents, consultants, and contractors to perform business functions on our behalf, including customer service, credit review, account servicing, customer research, marketing, provision of IT services, and records maintenance. We give these entities access to our customers' personal information to perform these functions for us. Additionally, we share personal information about you when you voluntarily use certain optional services and features we offer. For example, if you're a member of one of our third-party affinity programs, we'll share information concerning your purchases from us with the organization running that program. If you ask us to send a particular product to another person or use our notify-a-friend feature, we'll tell that person we're sending the product or email at your request. If you participate in a contest or sweepstakes or submit an employment application, we may share the information you submit with others assisting us in the administration of that feature. If you use one of our community functions, the content of your posting will be available to all other participants and will be accompanied by your username or chosen nickname.

It's possible that QVC or part of its business or one of its affiliates could merge with, acquire or be acquired by another business entity and your personal information could be among the assets transferred. We reserve the right to share personal information about you with our affiliates in the course of our business operations. We also reserve the right to share personal information about you when we believe this to be appropriate to comply with the law or in cooperation with legal authorities; to enforce the General Terms of Use governing use of this website and the terms and conditions governing the use of our other services; or to protect the rights, property, safety, or other interests of QVC and its customers.

If you make a purchase using QVC's Easy Pay program, QVC may disclose your information to a credit verification or risk assessment service provider which may use that information to provide credit verification or risk assessment services to QVC as well as use that information for other separate purposes of the service provider. If a customer fails to make payments for purchases under QVC's Easy Pay program, QVC may sell the customer's account and information related to the account (including customer information) to a third-party collection agency.

QVC participates in Online Behavioral Advertising (OBA), also referred to as Interest-Based Advertising (IBA), where ads are tailored to your interests. QVC works with service providers to help us collect non-personally identifiable information through our own cookies in order to deliver OBA display ads to our customers.

Facebook

If you're active on Facebook, QVC may also reach out to you with Facebook ads that are customized to your interests based on how you have interacted with our website and mobile apps. If you don't want QVC to present you with tailored Facebook ads, you can opt out through Facebook.

What are third-party affinity programs?

Occasionally, we participate in rewards programs with other business organizations where customers who are also members of these businesses will get a credit or a reward for their QVC purchases from the other member organizations. We also sometimes advertise QVC products on other services in the form of a link so that visitors can click over to our services and purchase the products if they're interested. In these situations, we share information about our customers' purchases with these other member organizations and other services under the contracts these entities have with QVC.

 

Do we collect personal information from children?

Our services are not intended for use by children, and the terms and conditions governing the use of our services require that you must be at least 18 years old to use them. In addition, we do not solicit or collect information from anyone who tells us that he or she is under 13 years of age.

 

Your rights under the California Consumer Privacy Act

This "Your Rights Under the California Consumer Privacy Act" section is referred to as the "CCPA Notice", and this CCPA Notice is effective on January 1, 2020. The California Consumer Privacy Act ("CCPA") provides certain new rights to "consumers" who are residents of California, and this CCPA Notice explains how QVC enables those rights for California residents who are customers or prospective customers using our services, and explains our California personal information practices as required by CCPA.

CCPA only applies to people who are California residents. However, if you are not a California resident, but would like to obtain information or take other actions that a California resident may take under CCPA, please communicate to QVC through the forms and links below, and QVC will use reasonable efforts to respond to your request.

CCPA requires a summary of personal information practices for the prior twelve months, updated annually, and that summary for calendar year 2019 is reflected in this CCPA Notice. We may update our Privacy Statement more frequently than annually, or provide additional notice such as at the point of collection, to reflect material changes in how we collect and use personal information.

This CCPA Notice supplements our other privacy notices and policies and shall govern in the event of a conflict between this CCPA Notice or other privacy notices and policies. However, if any other notice about CCPA is provided at the point of collection, then that other notice shall govern in the event of a conflict with this CCPA Notice as permitted by applicable law.

NOTE FOR NON-CUSTOMERS. Please note that this CCPA Notice does not apply to certain human resources data or business-to-business communications data, or those data subjects. COLLECTED PERSONAL INFORMATION.

Categories of Personal Information. QVC may collect personal information about customers and other users of our services who are California consumers including, during calendar year 2019, personal information within the following categories: identifiers; individual records; characteristics of protected classifications under California or federal law; commercial information; biometric information; internet or other electronic network activity information; geolocation data; audio, electronic, visual, or similar information; professional or employment-related information;  and inferences information. The personal information described in this paragraph reflects categories of personal information, disclosure of which is required by CCPA.

Other Personal Information. We may collect other information that meets CCPA's definition of personal information but is not reflected by a category. If we do collect such other information, we will treat it as personal information as required by the CCPA, but will not include it when we are required to describe our practices by category of personal information.

Non-Personal Information. As permitted by applicable law, we do not treat deidentified data or aggregate consumer information as personal information, and we reserve the right to convert, or permit others to convert, personal information into deidentified data or aggregate consumer information. Also, as permitted by applicable law, we may choose not to treat publicly available information as personal information. CCPA does not require us to re-identify information or to keep personal information longer than we need it to respond to requests.

SOURCES OF PERSONAL INFORMATION. QVC collects personal information from different sources., including, during calendar year 2019:

Personal information we collect from you. QVC collects some personal information that you provide directly to us. This can include contact information, payment information, order information, communication information, feedback information, preferences information, pictures and videos that you send to us, and other information you provide to us. In addition, a customer may share personal information about other people with us, including recipients of purchases.

Personal information we collect automatically. QVC collects some personal information automatically when you use our services. This can include browsing and use information; information about devices that you use to access QVC's services; information collected through cookies, pixels, and similar technology.

Personal information we create. QVC creates some personal information when you use our services or in the operation of our business. This can include analytics information; and inferences information.

Personal information we collect from third parties. QVC collects personal information from other companies. This can include updated address and shipping instructions information; credit information; information from advertisers; information from Facebook, Twitter and other similar platforms; information that is collected automatically through your use of our services; information from entities that provide information that supplements personal information we already have. The categories of third party sources may include advertising networks, internet service providers, data analytics providers, government entities, operating systems and platforms, social networks, and data brokers.

USES OF PERSONAL INFORMATION. QVC collects, sells and uses personal information for the following business or commercial purposes:

    • Personalizing user experience and marketing, including targeted product display; targeted marketing and advertising through the services; marketing through emails, text messages, and other communications methods; re-targeted marketing and advertising across other websites, devices, and platforms; auditing related to the performance of QVC's advertising and marketing efforts; engaging in analytics to personalize user experience;
    • Payment-related activities, including processing payments, checking credit-worthiness, evaluating payment options, managing installment payment programs, and managing private label credit card programs
  • Maintaining and improving services and user experience, including:
    • Creating and updating applications, websites, and other features or functionality used by QVC;
    • Debugging to identify and repair errors that may affect how the services function;
    • Engaging in analytics related to improving services or user experience; and
    • Product safety or quality activities.
  • Fraud prevention and information security, including:
    • Measures to verify identity when an account is used for ordering or when the account is otherwise accessed;
    • Detecting and responding to fraud or security incidents; and
    • Protecting against other malicious, deceptive, or illegal activity
  • Short-term, transient use permitted under CCPA
  • Internal research, including:
    • Conducting research, analytics, surveys, and focus groups to improve customer experiences, develop services and products, provide better marketing and advertising.
  • Other Business Purposes for which we provide notice, including:
    • Legal obligations, including prosecuting people responsible for fraudulent, malicious, deceptive or illegal activities; defending claims; notifying of product recalls or other issues related to products; enforcing and notifying of QVC's terms and conditions, privacy statement and other policies and changes to such terms and conditions, privacy statement and other policies; and for records retention purposes.
    • Disclosures that are exempt from the definition of “sale” under the CCPA, including disclosures at the consumer’s direction, use of identifiers to manage opt-outs, disclosures to our qualified service providers and disclosures as part of a merger, asset sale or other qualifying corporate transaction.
  • Any other of our operational purposes consistent with our applicable privacy statements.
  • Commercial Purposes: To make disclosures that are treated as a sale under the CCPA as more fully described in the next section.

 

DISCLOSURES AND SALES OF PERSONAL INFORMATION. We may disclose personal information to further the business purposes stated above, such as to our service providers. In addition, we may disclose personal information in a manner that CCPA treats as a “sale.” The concept of a "sale" under CCPA is different from what has traditionally been considered a "sale", e.g., selling a customer list for money. Under CCPA, a "sale" potentially includes other uses or disclosures of personal information to third parties outside QVC in a commercial context where an exception to "sale," as provided by CCPA, does not exist. Because the concept of "sale" is arguably so broad under CCPA, QVC may conceivably be deemed to "sell" personal information described in the categories below, even if such "sales" are not the exchange of that personal information for money. As the General Terms of Use require customers be 18 years of age or older to use our platforms, we have no actual knowledge of sales of information of consumers under 16 years of age.

Please note that QVC will treat your direction to QVC to complete a transaction with us as your direction to have QVC provide certain related personal information that may be included in your transaction to a small group of vendors who provide services to fulfill your transaction, and we do not treat that as a sale. These include payment processors, fraud prevention service providers, credit verification or risk assessment service providers, and shippers.

CCPA RIGHTS

RIGHT OF DELETION. If you are a consumer (as defined in CCPA), you have the right to request that QVC delete any personal information about you that QVC has collected from you, but CCPA permits QVC to exclude some personal information from a deletion request if that personal information is necessary for QVC to maintain for certain permitted purposes under CCPA. Accordingly, QVC will comply with deletion requests made under CCPA, but some personal information about you may be retained by QVC, as permitted under CCPA.

How to exercise right of deletion: If you are a consumer (as defined in CCPA), you may exercise your right to request deletion of your personal information by clicking here or by calling 1-800-367-9444 (7am-1am ET). To verify your identity when submitting a rights request, we may ask you for information you have provided or that we have collected as part of your account registration, recent transactions, or recent interactions with QVC. 

RIGHT TO OPT-OUT OF SALES.  QVC may sell certain personal information that QVC has collected about you as described above in the "Sales of Personal Information" section above. You can opt-out of sales of personal information by clicking below. However, please note that the concept of a CCPA "sale" is still evolving, and that will affect what uses of personal information are considered a "sale" and how an opt-out of a CCPA "sale" is implemented, particularly where information may be exchanged or accessed through the use of cookies and similar technologies.

There is not yet a consensus or guidance from the State of California as to if the collection of personal information (e.g., device ID and usage info) by third party cookies and technologies associated with our service is a sale by us of your personal information unless being done in a manner that the CCPA qualifies as a service provider activity or is otherwise exempt from sale. Accordingly, we currently are employing technology that will disable non-service provider cookies associated with our services, or signal to them to act only as a service provider, if you exercise an "opt-out of sale" request. We may modify our approach to cookies as the law develops. Please note further that some browsers, applications, and other platforms may have signals that may be characterized as "do not track" signals, but we do not understand them to operate in a way that indicates an "opt-out of sale" expression by you under CCPA. Accordingly, we currently do not recognize these as an "opt-out of sale" request. We understand that various parties are developing do not sell signals to enable "opt-out of sale" requests, and we may recognize certain such signals if we conclude such a program is appropriate.

RIGHT TO REQUEST TO KNOW. If you are a "consumer" as defined in CCPA, then you have the right to request that QVC disclose to you the following information:

1. Specific pieces of personal information that a business has collected about the consumer;

2. Categories of personal information the business has collected about the consumer in the prior 12 months, along with the following additional information:

  • Categories of sources from which the personal information is collected;
  • The business or commercial purpose for which the business collected or sold the personal information;
  • The categories of third parties with which the business shares personal information, and
  • for personal information that the business sold , the categories of personal information sold, and for each category the categories of third party recipients; and
  • for personal information that the business disclosed for a business purpose, the categories of personal information disclosed, and for each category the categories of third party recipients

 

How to exercise the right to know: If you are a "consumer" as defined in CCPA, you may exercise your right to request a copy of the information described under this "RIGHT TO REQUEST TO KNOW" section by clicking here or by calling 1-800-367-9444 (7am-1am ET). To verify your identity when submitting a rights request, we may ask you for information you have provided or that we have collected as part of your account registration, recent transactions, or recent interactions with QVC. We require a higher level of verification for a request for specific pieces of personal information than for a categories request and will evaluate a right to know request that fails to meet the level of verification required to obtain a copy of your personal information as a categories request. If we cannot verify you to a reasonable degree of certainty we will not provide any consumer-specific information and instead refer you to this privacy notice where you can learn about our data practices generally. 

RIGHT TO NON-DISCRIMINATION. If you are a "consumer" as defined in CCPA, then you have the right that a business shall not discriminate against you because you exercised rights under CCPA. However, we reserve the right to provide loyalty programs and other differential pricing and services as permitted by the CCPA, which will be subject to applicable terms and conditions of such programs.

LIMITATION OF RIGHTS; COMPLIANCE WITH APPLICABLE LAW. Notwithstanding anything to the contrary in this CCPA Notice, we may collect, use and disclose personal information as required or permitted by applicable law and this may override CCPA rights. In addition, we need not honor any requests to the extent that doing so would infringe upon our or any other person or party's rights or conflict with applicable law.

AUTHORIZED AGENTS. Authorized Agents as defined under the CCPA may submit requests on a consumer's behalf by submitting the request through the same means listed under the rights above. Agents must establish their qualification to act as an agent and QVC will still require verification directly from the consumer, unless the Authorized Agent possesses a power of attorney pursuant to Probate Code sections 4000 to 4465.
