QVC COMMENTS ON RESOLUTION OF FTC CLAIMS INQUIRY
WEST CHESTER, Pa. (March 19, 2009) – QVC, Inc., one of the world’s largest multimedia retailers, announced today it has settled a case brought against it in 2004 by the U.S. Department of Justice on behalf of the Federal Trade Commission (FTC). The FTC alleged that unsubstantiated claims were made about a few products sold on QVC from 2000 through 2003.
Under the settlement, QVC will pay the U.S. Government $7.5 million, $6 million of which will be made available to consumers who purchased the products in question, with the remainder constituting an agreed-upon civil penalty. The settlement involves neither a finding nor an admission by QVC of any wrongdoing or liability.
“From QVC’s standpoint, the settlement was driven largely by a desire to avoid further legal expenses in connection with events that occurred more than five years ago,” said Larry Hayes, QVC’s senior vice president and general counsel. “When the vendors offered these products on air, QVC firmly believed, and still believes, there was no deception in the way they were presented.”
When the case was originally brought by the FTC, QVC in turn filed claims against the companies that had sold the products to QVC and that had supplied spokespersons who made many of the on-air product claims challenged by the FTC. Those companies agreed to participate in the overall settlement of the case, and QVC accordingly settled its claims against them.
“The settlement’s requirement that QVC substantiate claims made as to the covered products – principally dietary supplements – is fully consistent with QVC’s existing policy,” added Hayes. “We are confident that our customers receive accurate information about products because we work very hard to ensure that the claims made on our programs about all of our products are supported by reliable scientific evidence. We will continue to promote quality products reliably and with integrity.”
