OFFICIAL RULES
QVC, Inc. (“QVC”) and Cottage Hill Nursery, Inc. (“CHN”) (collectively referred to as “Sponsors”) are sponsoring the COTTAGE FARMS NAME THIS ROSE SWEEPSTAKES.
NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. By entering this Sweepstakes, entrants agree to abide by all terms of these Official Rules and the decisions of the Sponsors which shall be final and binding.
HOW TO ENTER: Sweepstakes to commence on March 16, 2008 at 12:00:01 AM ET. Limit of one (1) entry per person either by mail, by automatic entry with the purchase of item number M16661, Cottage Farms 3-Piece Pink Floribunda Rose Collection, or online via www.QVC.com/XXXX. All multiple entries will be discarded. All Eligible persons who purchase a Name-A-Rose variety rose plant from CHN over QVC between March 16, 2008 (12:00:01 AM ET – 11:59:59 PM ET) and April 1, 2008 (12:00:01 AM – 11:59:59 PM ET) will automatically be entered in the sweepstakes. As an alternative, persons may (A) hand print their name, address, day and evening phone number, age, and e-mail address (if any), on a hand-addressed 4 inch by 6 inch postcard, and mail the postcard to: COTTAGE FARMS NAME THIS ROSE SWEEPSTAKES, Box 2025 West Chester, PA 19380-4262. (Please note: Envelope entries and entries on smaller or larger postcards will be discarded); OR (B) log onto www.qvc.com/cottagefarmssweepstakes and complete the online entry form with your name, address, home phone and email address. Incomplete or illegible entries will be automatically excluded. Any other attempted form of Sweepstakes entry is void. Any person who attempts to participate with multiple e-mail or street addresses, under multiple identities or uses any device to artifice to enter more than once will be disqualified; use of programmed, automated or like means of entry is prohibited. All duplicate entries and copied/facsimile entries will be discarded. QVC’s computer is the official clock for determining the timeliness of receipt of online entries and purchase entries.
All online entries must be received by 11:59:59 PM ET on April 1, 2008; postcard entries must be postmarked by April 1, 2008 and received on or before April 8, 2008.
The Sponsors are not responsible for lost, misdirected or late entries caused by hardware or software errors or other technological malfunctions or failure of any kind or invalid/non-operational email address, disconnection or garbled email transmissions or lost, late, mutilated, misdirected or postage-due mail. The Sponsors are not responsible for the failure of the delivery carrier responsible for delivery of any entry.
The Sponsors are also not responsible for any incorrect or incomplete Sweepstakes information on www.qvc.com, whether caused by web site users, the equipment or programming associated with or utilized in the Sweepstakes or other cause. In the event of a dispute, all email entries will be deemed to have been submitted by the Authorized Holder of the email address who shall be considered the valid entrant. "Authorized Holder" as used herein is the natural person who is registered with the Internet service provider (or similar provider) for the email address.
If the Sponsors determine, in their sole discretion, that the Sweepstakes cannot be conducted online or via qualifying product purchase as originally planned (e.g., virus, bug, tampering, fraud), the Sponsors reserve the right at their sole discretion to cancel, modify or suspend the online component and/or qualifying product purchase component of the Sweepstakes and select the winner from among all eligible mail-in entries received, all eligible purchase entries received prior to and/or after (as appropriate) the action taken by Sponsors (if appropriate) and all eligible online entries received prior to and/or after (as appropriate) the action taken by Sponsors (if appropriate) or via some other means determined by Sponsors to be fair, appropriate and consistent with the spirit of these Official Rules. In such event, notice will be posted on www.qvc.com/cottagefarmssweepstakes.
DRAWING – Winner will be determined by a random drawing from all eligible entries which will occur on or about April 9, 2008. The number of eligible entries received will determine the odds of winning. Winning entry subject to validation. At the Sponsors’ sole discretion, Winning entry may be announced during a live QVC show on or around April 22, 2008.
PRIZES: There is no tangible prize or other prize of any monetary value. The prize is the opportunity to submit to the American Rose Society a proposed varietal name for a new rose variety which may be sold by CHN over QVC on March 16, 2008.
The selected entrant (winner) to have the opportunity to select the varietal name for a new pink Floribunda rose. The winner, working with a Cottage Hill Nursery Inc. (CHN) representative, will select an appropriate name for the rose using the guidelines and nomenclature established by the American Rose Society (ARS). Winner understands and agrees that CHN will have the final right of approval over name of varietal and CHN is no way obligated to use any names proposed by winner. If CHN determines in its sole discretion that winner is not cooperative or is inappropriate in his/her dealings with CHN in conjunction with name selection process, prize will be forfeited without compensation of any kind. Once a name has been approved by CHN in its sole discretion, CHN will seek to register the name with the ARS. Winner agrees to assist CHN in such registration efforts, upon CHN’s request, without compensation of any kind. Should the registration be approved by ARS, CHN will have the right (as between CHN and the winner) to market the rose using the name selected by the winner without compensation or further notice to winner. Nothing herein, however, in any way obligates CHN to make any marketing (or other) use of the name. And, even if CHN elects not to make any use of the name, winner will not have any rights to use the name.
If a Winner declines the prize for any reason, he/she will be disqualified and the prize forfeited; and, in such event, an alternate Winner shall be selected from among all remaining eligible entries received. Prize cannot be substituted or transferred by Winner. If a Prize must be forfeited, Winner will not receive any compensation. Prize Winner is solely responsible for all expenses relative to acceptance/use of prize. PRIZE PROVIDED BY COTTAGE FARMS ("Prize Provider").
By entering the Sweepstakes, each entrant accepts and agrees to be bound by these Official Rules and by the decisions of the Sponsors. The Winner of this Sweepstakes will be notified by telephone and by mail and shall be required to execute and return an affidavit of eligibility, liability release, and (where legal) an affidavit of publicity within the indicated time period. Noncompliance within this time period or return of prize notification as undeliverable will result in disqualification with an alternate Winner being selected. Sponsors reserve the right to disqualify any individual that Sponsors determine in their sole discretion to be tampering with the Sweepstakes (including the entry process). Sponsors may prosecute fraudulent activities to the full extent of the law. Unless otherwise prohibited by law, Winner grants Sponsors and their affiliates and subsidiaries permission to use Winner’s name and likeness for advertising/trade/promotional purposes and to disclose Winner’s first name and city of residence without further notice or further compensation. Winner agrees to release and hold harmless Sponsors and their affiliates and subsidiaries and their directors, officers, employees, and agents from any damage, injury, loss or other liability that might arise from his/her participation in this Sweepstakes, or from his/her acceptance, use/misuse of prize. CHN retains the absolute discretion to reject a proposed varietal name for any reason (or no reason) including those names that it deems offensive, defamatory, scandalous, or involving a potential trademark infringement risk. Any name selected by the Winner and not rejected by CHN will be submitted by CHN to the American Rose Society with the request that the name be selected for the new variety. CHN cannot and does not guarantee that the American Rose Society will honor that request and the decision as to acceptance of the proposed name will be entirely that of the American Rose Society (an independent third party entity which has not sponsored, authorized or endorsed this Sweepstakes).
To the extent that the variety or its selected name might be the subject any potential patent or trademark protection, the rights to apply for and perfect such interests are exclusively CHN’s, and the Winner by accepting the prize fully relinquishes any and all claims to such rights without compensation or notice of any kind. Notwithstanding the foregoing, winner agrees upon CHN’s request and without compensation of any kind to complete and sign any and all documents deemed necessary by CHN in its sole discretion so as to record, perfect or effect its rights. The Winner also agrees that CHN may, in marketing the particular variety of rose involved in the sweepstakes, use the name selected by the Winner as well as other names for the particular variety without compensation or notice of any kind.
ELIGIBILITY – The Sweepstakes is open to residents of the 50 U. S. States and the District of Columbia who are 18 years of age or older at the time of entry. Employees, officers and directors of the Sponsors and affiliates, or members of their immediate families are NOT Eligible. By participating, entrants agree to abide by these Official Rules, including all eligibility requirements. All of the Sponsors’ eligibility decisions are final and binding in all respects. This offer is void where prohibited by law, and is subject to all federal, state and local laws and regulations.
